1.1 These terms and conditions govern your use of the Gildevlin.com website and any coaching services or digital products you engage in with Gil Devlin; by using this website and/or engaging our services, you accept these terms and conditions in full. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use this website or engage our services.
1.2 You must be at least 18 years of age to use this website and engage our services. By using this website and by agreeing to these terms and conditions you warrant and represent that you are at least 18 years of age.
1.3 This website uses cookies. By using this website and agreeing to these terms and conditions, you consent to Gildevlin.com’s use of cookies in accordance with the terms of Gildevlin.com’s privacy policy.
2. LICENCE TO USE WEBSITE
2.1 Unless otherwise stated, Gil Devlin and/or her licensors own the intellectual property rights in the website and material on the website. Subject to the licence below, all these intellectual property rights are reserved.
2.2 You may view, download for caching purposes only, and print pages or other content from the website for your own personal use, subject to the restrictions set out below and elsewhere in these terms and conditions.
2.3 You must not:
• re-publish material from this website (including republication on another website);
• sell, rent or sub-licence material from the website;

• reproduce, duplicate, copy or otherwise exploit material on this website for a commercial purpose;
• edit or otherwise modify any material on the website; or

4.2 If Gil Devlin provides you with a user ID and password to enable you to access restricted areas of this website or other content or services, you must ensure that the user ID and password are kept confidential.
4.3 Gil Devlin may disable your user ID and password at her sole discretion without notice or explanation.
5. USER CONTENT
5.1 In these terms and conditions, “your user content” means material (including without limitation text, images, audio material, video material and audio-visual material) that you submit to this website, for whatever purpose.
5.2 You grant to Gil Devlin a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, adapt, publish, translate and distribute your user content in any existing or future media. You also grant to Gil Devlin the right to sub-licence these rights, and the right to bring an action for infringement of these rights.
5.3 Your user content must not be illegal or unlawful, must not infringe any third party’s legal rights, and must not be capable of giving rise to legal action whether against you or Gil Devlin or a third party (in each case under any applicable law).
5.4 You must not submit any user content to the website that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaints.
5.5 Gil Devlin reserves the right to edit or remove any material submitted to this website, or stored on server infrastructure, or hosted or published upon this website.
5.6 Notwithstanding Gil Devlin’s rights under these terms and conditions in relation to user content, Gil Devlin does not undertake to monitor the submission of such content to, or the publication of such content on, this website.
6. COACHING PROGRAMME TERMS
6.1 The materials and content provided to you as part of the coaching programme are confidential and proprietary to Gil Devlin. They are published works protected by copyright, and you are not permitted to use, disclose, copy, adapt, or distribute them outside of your own company. You may use the materials for the internal business purposes of your company but may not redistribute them to other businesses or individuals.
6.2 Our services are for guidance and educational purposes only and are not to be considered professional business advice. You are solely responsible for the implementation of the coaching services and any outcomes resulting from them. You agree to indemnify and hold harmless Gil Devlin from any losses, costs, or expenses arising from your activities related to the coaching programme. The coach’s role is to support your development; the results of the programme are dependent on your active participation and commitment.
6.3 The coaching arrangement is non-exclusive. Gil Devlin retains the right to offer services to other businesses, including those in similar industries.
6.4 Consultations may be rescheduled, subject to availability. To avoid forfeiture of the session and any related guarantee conditions, you must provide a minimum of 24 hours’ notice for any cancellation or rescheduling request.
6.5 To be eligible for any return on investment guarantee offered, you must fulfil the following conditions: timely completion of all agreed tasks, submission of coaching log including an update on agreed actions to your coach prior to each session and attendance at all scheduled coaching sessions. If, within 12 months of the initial coaching session, the additional gross profit generated by your business does not at least equal the investment made in the coaching programme, Gil Devlin will refund you the difference between your investment and the verifiable return.
6.6 Either you or your Coach may terminate this agreement at any time by providing 30 days’ written notice. Upon termination, the next scheduled monthly payment following the notice period will be the final payment due.
6.7 These agreements set out in the Coaching Programme Terms is the entire agreement between you and Gil Devlin, with all prior agreements and representations being superseded herein. This agreement shall be governed by, construed, and interpreted in accordance with English law.
7. PAYMENT, DIGITAL DELIVERY & REFUND TERMS
7.1 All services and digital products must be paid for in full prior to the delivery of said services, products, or assessment access.
7.2 For coaching programmes, you will be billed on a monthly, quarterly, or annual basis, as agreed upon in your programme contract. We use GoCardless for the processing of monthly recurring payments via direct debit, and for some one-off payments.
7.3 For one-off products, such as DISC assessments, online training, and other digital products, payment will be processed in full before you receive access. Access links for DISC assessments or digital training portals will only be generated and issued once full payment has cleared into our account.
7.4 Digital Content & Refund Policy: In accordance with the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013, by purchasing a digital product or assessment (including DISC assessment links and online training access), you consent to the immediate performance of the contract and acknowledge that you lose your statutory right to cancel or request a refund once access links or digital materials have been issued. Except where explicitly stated under a written ROI guarantee, all sales of digital products and assessments are non-refundable once issued.
8. SERVICE DELIVERY & TECHNICAL REQUIREMENTS
8.1 Coaching and training consultations are delivered remotely via Zoom Workplace. You are responsible for ensuring you have adequate internet access, hardware, and audio/visual setup to participate in scheduled sessions.
8.2 Online training programmes are hosted on the Thinkific platform. DISC assessment links are dispatched via an automated secure third-party provider.
8.3 Gil Devlin shall not be held liable for failure or delays in service delivery resulting from client-side technical malfunctions, third-party software outages, or internet failure.
9. NO WARRANTIES
9.1 This website and its coaching services are provided “as is” without any representations or warranties, express or implied. Gil Devlin makes no representations or warranties in relation to this website, the information and materials provided on it, or the outcome of any coaching programme.
9.2 Without prejudice to the generality of the foregoing paragraph, Gil Devlin does not warrant that:
- this website will be constantly available, or available at all; or
- the information on this website is complete, true, accurate or non-misleading.
9.3 Nothing on this website or in the coaching services constitutes, or is meant to constitute, legal or financial advice of any kind.
10. LIMITATIONS OF LIABILITY
10.1 Gil Devlin will not be liable to you (whether under the law of contract, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this website or the coaching services:
- to the extent that the website is provided free-of-charge, for any direct loss;
- for any indirect, special or consequential loss; or
- for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.
10.2 These limitations of liability apply even if Gil Devlin has been expressly advised of the potential loss.
11. EXCEPTIONS
11.1 Nothing in these terms and conditions will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in the terms and conditions will exclude or limit Gil Devlin’s liability in respect of any:
- death or personal injury caused by Gil Devlin’s negligence;
- fraud or fraudulent misrepresentation on the part of Gil Devlin; or
- matter which it would be illegal or unlawful for Gil Devlin to exclude or limit, or to attempt or purport to exclude or limit, her liability.
12. REASONABLENESS
12.1 By using this website or engaging our services, you agree that the exclusions and limitations of liability set out in these terms and conditions are reasonable.
12.2 If you do not think they are reasonable, you must not use this website or engage our services.
13. INDEMNITY
13.1 You hereby indemnify Gil Devlin and undertake to keep Gil Devlin indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by Gil Devlin to a third party in settlement of a claim or dispute on the advice of her legal advisers) incurred or suffered by Gil Devlin arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.
14. BREACHES OF THESE TERMS AND CONDITIONS
14.1 Without prejudice to Gil Devlin’s other rights under these terms and conditions, if you breach these terms and conditions in any way, Gil Devlin may take such action as she deems appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.
15. VARIATION
15.1 Gil Devlin may revise these terms and conditions from time to time. Revised terms and conditions will apply to the use of this website from the date of the publication of the revised terms and conditions on this website. Please check this page regularly to ensure you are familiar with the current version.
16. ASSIGNMENT
16.1 Gil Devlin may transfer, sub-contract or otherwise deal with her rights and/or obligations under these terms and conditions without notifying you or obtaining your consent.
16.2 You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.
17. SEVERABILITY
17.1 If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
18. ENTIRE AGREEMENT & GOVERNING LAW
18.1 These terms and conditions constitute the entire agreement between you and Gil Devlin in relation to your use of this website and the coaching services, and supersede all previous agreements in respect of your use of this website and the coaching services.
18.2 These terms and conditions shall be governed by and construed in accordance with English law, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of England and Wales.
